Earlier this year, the Egg Farmers of Alberta (EFA) used the lessons learned from a lean consultant to streamline some of their in-house processes. The EFA staff mapped out the many steps involved in collecting and organizing information from egg farmers, hatcheries and laboratories. The EFA was automating more of their data collection to help the industry manage enhanced flock health monitoring and the associated paperwork. The testing is part of the organization?s commitment to control and prevent reportable diseases under the Animal Health Act (Alberta).

?We knew that the launch of an enhanced flock monitoring program would stretch our resources,? explains Christina Robinson, producer services manager for EFA, who led the project at the Egg Farmers? office. ?By bringing in a coach to teach us about lean, we were able to reconstruct our processes in a way that cut out waste and optimized the use of our resources. We are now able to carry out our enhanced program, which has approximately three times the output, with the same administrative resources as our original program. The best part is that our staff now has the skills necessary to tackle other processes in our organization, keeping us on the path of continuous improvement.?

At the EFA regional meetings, June 19 to 21, 2012, Robinson will describe how lean can work for farmers who want to increase efficiencies in their own businesses. Having had first-hand experience with the lean process, Robinson can see clear advantages. ?Lean tools can be used in any type of operation, whether it is an office or a farm. We are excited to pass on our knowledge about lean to egg farmers, so that they can find ways to make some of the jobs they do every day easier, and to make their businesses more successful.?

Alberta?s 154 registered egg farmers are focused on continuous improvement and high quality product, so the lean coaching was a good fit for the organization. New lean management ?tools? for the staff toolbox were part of the onsite coaching.

?The team at Egg Farmers of Alberta was very goal-oriented. The staff really wanted lean to help them support their industry in its efforts to supply the very best product to market,? observes Park.

?They worked diligently and learned about the tools and techniques they could apply to other areas at their workplace, as well,? says Nicola Stevens, manager, Productivity Improvement Initiative at Alberta Agriculture and Rural Development. ?For organizations open to change and committed to spend the time necessary, lean coaching works. There can be significant gains in efficiency, work quality and employee engagement.?

The Truth About the Numbers | Yinzercation

Oh those halcyon pre-stimulus days. Governor Corbett and his allies have a habit of making outrageous claims about our state budget, then repeating them over and over again hoping that people will believe them. Lately we?ve been hearing again that the governor is merely returning state education funding to its level before Pennsylvania accepted federal stimulus dollars. (This has been a common claim since January, see ?A Shameful Betrayal.?)

Amanda Godley and Paul Foster have done some digging into this absurdity and conclude, ?His claim is not supported by the facts.? Using official state documents, they double and triple-checked their numbers and found the following:

The short story

  • In 2008-09 (pre-stimulus), under Gov. Rendell, the state spent $9.597 billion on PK-12 education (?basic education?).
  • In 2011-12, under Gov. Corbett, the state spent $9.225 billion on PK-12 education (?basic education?).
  • So Corbett allocated $372 million LESS last year for PK-12 education than the state spent pre-stimulus in 2008-09.

Note that there is a line item within the category ?PK-12 Education ? Basic Education? that is called ?basic education funding? and this is the line item that Corbett usually refers to when he claims that he has simply returned state education funding to pre-stimulus amounts. But there are many, many other line items in the section of the state budget entitled ?PK-12 Education ? Basic Education? (things like transportation, early intervention, special education, etc.) that Corbett has reduced or eliminated. So when he refers to his ?basic education spending? in claims that he is not reducing state funding for PK-12 education, he is trying to trick the public into believing that he is referring to ALL state funding for PK- 12 education rather than just one line item. (See ?Dishonesty Disguised as Generosity.?)

Just last week, Corbett?s spokesman, Kevin Harley, tried this trick, claiming that the governor has ?added more? to Basic Education and that ?Pennsylvania taxpayers now pay more toward Basic Education than at any time in the state?s history.? [Pittsburgh Post-Gazette, 5-23-12] But in a rare moment of full disclosure, even Corbett admitted the truth back in February, saying, ?We reduced education funding if you look at it as a whole. ? and if you listen to my words, I always talk about the basic education funding formula [also referred to as the basic education subsidy].??[Capitolwire, 2-9-2012 (subscription service); for reference, see PADems 2-10-12]

The Long Story
To figure out the 2008-09 actual spending on education, Amanda and Paul examined Gov. Rendell?s 2010-11 Executive Budget, which reports actual 2008-09 spending on education. On page 513-14 (labeled E14.15-16 at the bottom), you?ll find the PK-12 budget numbers. The leftmost column, ?Actual,? is what was spent in 2008-09. The total is $9.597 billion.

To figure out the 2011-12 spending on education, they examined Gov. Corbett?s 2012-13 Executive Budget proposal, published in February. Pages 496-497 (labeled E15.12-13 at the bottom) report 2011-12 education spending under the middle column entitled ?2011-12 available.??This budget does not follow the exact same format as the 2010-11 budget document, so these two sleuths double checked that they had accounted for the all programs (when programs were not cut). As we have reported here before, Gov. Corbett eliminated a number of line items and consolidated them under ?Education Block Grant? to appear as if he has increased education funding, but this is just an attempt to hide decreases in funding.

Furthermore, if you compare the column entitled ?2011-12 available? to the ?2012-13 budget? (what Gov. Corbett is proposing for next year) you can see that the governor is proposing decreases in many categories for next year, too. The only category that is increased is employees? pensions.

The Bottom Line
When Gov. Corbett insists that he is simply taking us back to the days before federal stimulus dollars, he is not being truthful. This governor actually spent $372 million less last year on public preK-12 education than the state spent before it started using federal stimulus money. It?s convenient to blame the loss of stimulus dollars for our current budget woes, but these numbers make it clear that Gov. Corbett is using that as a cover story. What he is really doing is slashing public funding for one of our most cherished public goods: our children?s future.

While this this may sound at odds with the idyll of an organic farmer toiling away in the fields, the research team says the lasers eliminate the need for toxic herbicides and labor-intensive weed control.

The drones would seek out and destroy weeds by frying their growth centers with a finely-tuned laser beam, according to scientists working on the project at Leibniz University and Laser Zentrum Hanover.

Sensors and sophisticated algorithms on board the drones would allow the robots to distinguish between weed and crop and determine the right strength of the beam required to kill the weed.

To date, the team has demonstrated the technology in the lab and greenhouse where the laser is mounted on a track over the weeds.

The next step is to deploy the technology in the field. This is tricky since the vibrations of tractor-mounted system would interfere with accuracy, leading to fried crops as well as weeds.

Hence, the idea of mounting the lasers on drones, which the team apparently thinks might be steadier.

The historical calendar is in line with the dates of New York's 3-2 comeback over the Devils the last time these division and area rivals met in the Eastern Conference finals in 1994. None of the names are the same for the Rangers, and only New Jersey goaltender Martin Brodeur ? and assistant coach Larry Robinson ? still have the same jobs as way back when.

So the top-seeded Rangers' point of reference as they head into Game 6 in New Jersey on Friday night isn't the history book but rather their shared experience of rallying past Ottawa.

If they extend their season, they will be back at home on Sunday for a winner-take-all game.

"You can draw off that experience, just the feelings going into the game," Rangers captain Ryan Callahan said. "Just stay even keeled about it. We've got to go into an opposing building and win one game and get it back to the Garden.

"They're going to be a desperate team, too, to close it out on their home ice. We need to find that next level, that extra desperation. Obviously, it's a huge game, but we don't need to say that."

New York has embraced desperation much more than prosperity this postseason. The Rangers have won two in a row in a series only once and have never enjoyed a two-game lead in any of their three matchups. However, they are 3-0 when facing elimination ? including Game 7 victories over Ottawa and Washington.

"We've been through these situations a lot this year, including in the playoffs," Rangers coach John Tortorella said Thursday after practice. "I'm very comfortable as far as our mindset. Today was a good day for us. As we approach our game, I'm very comfortable in where we're going to go."

That was not as easy to see Wednesday night in New York's 5-3 home loss to the Devils in Game 5. The Rangers fell behind 3-0 less than 10 minutes into the game, but managed to tie it in the opening minute of the third period.

However, a goal with less than five minutes remaining by Devils fourth-line forward Ryan Carter finished the Rangers for good. The loss was New York's first in these playoffs in which it scored at least three goals.

"It's a good group," Tortorella said. "It's a group that stays with it. There's not a lot of panic there. They just go about their business, and we're a pretty good hockey team."

They were the best in the East over the 82-game regular season, and they tied for the second-most points in the entire NHL. All that will be an afterthought if the Rangers fail to get to a finals matchup with the upstart Western-champion Los Angeles Kings.

If confidence can be conveyed in words, then the Rangers seem loaded with it as their season hangs in the balance.

Tortorella said goaltender Henrik Lundqvist will rebound from a subpar performance in Game 5 and "play his best game tomorrow night." He echoed that sentiment for top-line forward Brad Richards, who also struggled on Wednesday.

"It's tough when you go into a game like this. You want to win so bad, sometimes it's more pressure than you need," Lundqvist said. "When you're out there, you try to focus on the things you always focus on. The challenge every time you play an important game is to find a good balance mentally, but I'm trying to approach it the same way."

Tortorella is a master motivator, whether it be with words of encouragement or a dose of tough love that often results in benchings within games. No one is immune from that, as leading scorer Marian Gaborik found out in the Rangers' Game 2 loss.

The coach also has been less contentious with reporters recently, making postgame news conferences calmer even as the stakes have risen during the East finals.

Tortorella is no stranger to digging out of 3-2 holes. He coached the Tampa Bay Lightning to the championship in 2004, erasing such a deficit in the finals against the Calgary Flames.

"I don't have to motivate the team," Tortorella said. "I think our team is motivated. I don't look at it as overcoming a 3-2 deficit. We need to win a hockey game. We're preparing to try to win one hockey game, and we'll see after that.

"We prepare as we always do. There's no magic. There are no special speakers coming in. There is none of that."

Richards scored two goals in that Game 6 win for Tampa Bay, and Ruslan Fedotenko ? now his teammate again with the Rangers ? found the net twice in Game 7 to lock up the Cup for the Lightning.

That experience would seem to be invaluable, but maybe not.

"That was a really long time ago, and I had a concussion at that time so I can't remember really anything," Fedotenko said with a wry smile. "I remember winning, but that is basically it."

Classic 1937 steam engine soon to run carbon-free

A steam train built in 1937 is getting a makeover that will turn it into a ?higher-speed? locomotive that runs on biocoal, a coal-like fuel made with woody plant material.

When finished, the train will be able chug along existing tracks at speeds up to 130 miles per hour without contributing to the greenhouse gas pollution blamed for global warming.

?Computer simulations already show that the locomotive is about as powerful as two modern passenger diesel locomotives,? Davidson Ward, president of the Coalition for Sustainable Rail, told me Thursday.

?But it will burn carbon neutral fuel.?

The biocoal is based on a so-called torrefaction process pioneered at the University of Minnesota in Duluth. To make it, woody material ? in this case trees ? are heated in the absence of oxygen. The resulting flaky matter is then rammed together under high pressure to create coal-like bricks.

Biocoal has the same energy density as regular coal, but is cleaner burning, and since trees (the fuel source) sequester carbon as they grow, the system is considered carbon neutral, according to Ward.

The heat used to process the fuel comes from biogas, which makes the process 94 to 96 percent thermally efficient, he said.

?So you actually do have something that is as close to carbon neutral as possible,? he noted.

The biocoal will be used to power a 1937 steam locomotive that is being upgraded with a more efficient fire box, boiler and other parts ? though using the same design principles as a traditional steam locomotive.

?It is kind of like the windmill,? Ward said. ?Windmills are very old inventions, but you can modernize it and make it more efficient and apply it today.?

With sufficient funding, the team expects their made-over train to light up the rails sometime in the next two to six years.?

The train will be classified as "higher-speed," which means it can travel on the same rail network as Amtrak and freight trains.?

Rails for high-speed trains, which go 150 to 220 miles per hour, require more specialized tracks.

Today, most higher-speed passenger trains are diesel-electric locomotives, which generate their peak horsepower at low speeds ? about 25 miles per hour. Steam locomotives, by contrast, get their peak horsepower at higher speeds ? about 40 miles per hour.

"Initial computer simulations suggest that the CSR's modern steam engine will significantly out-accelerate a modern diesel-electric locomotive to 110 mph," according to the coalition's website.?

In addition to trains, the steam engine technology can be used to create ?self-contained energy generation units? that could be shipped to the developing world, including the torrifier.

And since these units are based on age-old steam engine technology, they won?t require high-tech skills to perform routine maintenance or fix broken parts.?

The train itself, which Ward?s organization acquired from a museum in Kansas, is considered a proof-principle project. If all goes according to plan, they might build a new steam locomotive from scratch, which will have some modern looks.

For example, ?no cowcatcher,? Ward said. ?You don?t need a cowcatcher today unless you are a 'Back to the Future' fan.?

London, UK (May 23, 2012) The British Association for Psychopharmacology (BAP) has released fresh guidelines on the best methods to treat substance abuse and addiction in the Journal of Psychopharmacology, published by SAGE. A panel of experts has carefully researched the new, comprehensive guidelines, offering practitioners a detailed review of the evidence to help them optimise their clinical decisions.

The new BAP guidelines target treatment of substance abuse, harmful use, addiction and comorbidity with psychiatric disorders, and primarily focus on pharmacological management. They represent a substantial revision of the first BAP evidence-based guidelines for "the pharmacological management of substance misuse, addiction and comorbidity," which were published in 2004. The new guidelines also take into account a number of recent documents from the UK National Institute for Health and Clinical Excellence (NICE), and other organisations.

The expert panel behind the updated guidelines searched for new evidence to offer practitioners recommendations based on the most respected and relevant research in the field. They considered pharmacological management of alcohol, nicotine, opioids, benzodiazepines, stimulants, and associated co-morbidity with mental health problems and substance use or abuse in pregnancy. The experts also reviewed the latest research into pharmacotherapy for younger and older people, those with personality disorder, and addressed 'club drugs,' cannabis and polydrug users. As well as pharmacotherapies in common clinical use, the panel also covers those with limited but promising evidence, and highlights important areas of 'key uncertainty'.

The new guidelines detail pharmacological interventions targeting the following areas:

  • withdrawal syndromes
  • relapse prevention and abstinence maintenance
  • reducing harms associated with illicit drug use by prescribing a substitute drug or drugs (e.g. methadone maintenance treatment)
  • preventing substance use complications (e.g. use of thiamine to prevent Wernicke's encephalopathy and Korsakoff's syndrome).

"Our aim is to provide helpful and pragmatic guidelines for clinicians such as psychiatrists and GPs involved in prescribing to people with substance abuse or harmful use alone and with psychiatric comorbidity," says Anne Lingford-Hughes of Imperial College, London, lead author of these guidelines, who also co-authored the original 2004 BAP guidelines. "The update should also be of interest to other practitioners in the substance misuse field, non-specialists, patients and their families," she adds.

(AP) ? The leaders of the 27 countries that make up the European Union are to meet in Brussels Wednesday to try and find a way to keep the debt crisis in Europe from spiraling out of control and promote jobs and growth.

On Tuesday the Organization for Economic Cooperation and Development warned that the 17 countries that use the euro risk falling into a "severe recession." It called on governments and Europe's central bank to act quickly to keep the slowdown from dragging down the global economy.

The electoral turmoil in Greece threatens to pull apart the eurozone. Borrowing costs are up for the most indebted governments. There is an increasing number of reports of worried savers and investors pulling funds out of banks that are seen as weak. Meanwhile, unemployment is soaring as recession grips nearly half the eurozone countries.

However, switching the conversation from slashing budgets to promoting growth won't be easy. And actually producing growth will be even harder.

WHAT'S ON THE AGENDA

For the past few years, fiscal austerity was all was all anyone ever talked about in Europe. That had a certain logic since governments were facing rising borrowing costs on bond markets, a sign that investors are nervous about the size of their ballooning deficits. Austerity was intended to address this nervousness by reducing a government's borrowing needs. For the people of Europe, austerity meant layoffs and pay cuts for state workers, scaled-back spending on welfare and social programs, and higher taxes and fees to boost government revenue.

At the height of the debt crisis last winter, the eurozone ? led by Germany's Chancellor Angela Merkel ? proposed a so-called "fiscal pact" that would tie member countries to strict fiscal and deficit targets.

But, as many economists had predicted, austerity has dragged down already fragile economies and, as economic output shrinks, the debt burden actually looks worse.

As a way out of this problem, economists and politicians have called for measures that would help a country's economy grow. France's new Socialist President, Francois Hollande, has led the charge, insisting during his campaign that he would not sign Europe's fiscal pact until it includes measures to promote growth.

Economists recommend pro-growth measures including reducing red tape for small businesses, making it easier for workers to find jobs across the eurozone and breaking down barriers that countries have created to protect their own industries. Some economists go a step further and say governments should actually increase spending while economies are so weak ? and make reining in deficits a longer-term goal

However the question of how to produce growth for Europe is a sticky one. Germany, which led the push for austerity, insists that growth will be the product of tough reforms, like ones it undertook to liberalize its economy over a decade ago. Others say such reforms will take a while to bear fruit and more needs to be done right now ? such as extending the deadline for deficit targets and waving through wage increases.

HOW DO YOU PROMOTE GROWTH?

Leaders at Wednesday's summit in Brussels ? like the heads of the world's leading economies at the G8 meeting at Camp David last weekend ? are expected to tread a fine line between talking about ways to promote growth and sticking to commitments to balancing budgets.

So where will the money to boost growth come from? One area could be the better use of the resources already at the European Union's disposal. The EU has a pot of so-called "structural funds", many of which are going unused even though several countries are in desperate need of cash. Putting those to use will be one topic Wednesday. Countries are also expected to discuss increasing the size of the European Investment Bank so that it can, in turn, lend more money to struggling small businesses.

Diplomats have already agreed to issue EU "project bonds" ? debt issued jointly by the union ? which can be used to fund major infrastructure projects. Hollande campaigned strongly on this idea, and even Germany, which was initially opposed to any jointly held debt, has softened its position. However, only a pilot phase of the project has been approved.

WHAT'S LIKELY TO BE CONTENTIOUS

The idea of project bonds are seen by many politicians and economists as a step towards so-called "eurobonds" ? jointly issued bonds that could be used to fund anything and could eventually replace an individual country's debt. Eurobonds would protect weaker countries, like Spain and Italy, by insulating them from the high interest rates they now face when they raise money on bond markets. Those high interest rates are ground zero of the crisis: They forced Greece, Ireland and Portugal to seek bailouts.

EU President Herman Van Rompuy has encouraged participants on Wednesday to discuss "innovative, or even controversial, ideas." He has suggested that nothing should be taboo and that long-term solutions should be looked at. That seems to point to a conversation about eurobonds.

But Germany is still staunchly opposed to such as measure. On Tuesday, a senior German official stressed that despite the pressure from some other European countries, Merkel's government has not eased its opposition.

"You can wake me up in the middle of the night, at 3 a.m., and then I will tell you what our position is ? also at 5 a.m., it doesn't matter. We think that eurobonds are not the right path for many reasons and in our opinion they cannot be part of a growth strategy," said the official, who briefed reporters on condition of anonymity in line with government policy.

What was needed instead, the official insisted, was work to eliminate the underlying problems by trimming the nations' high debt burden and restoring their competitiveness through structural reforms.

WILL ANY OF THE SOLUTIONS WORK?

The problem with many of the solutions on the table is that even if they are all implemented, they would likely take years to yield growth. And Europe needs faster answers.

To that end, many economists are pushing for a larger role for the European Central Bank ? the only institution powerful enough to have an immediate impact on the crisis. If Europe's central monetary authority was given the power to buy up country's bonds, that government's borrowing rates would be pushed down to more manageable levels.

"In the immediate future, the ECB will remain the only institution with the resources, speed of action, and policy instruments necessary to shore up confidence in the single currency area, a role we expect it will play, should conditions necessitate," a Eurasia Group note said Tuesday.

WHY IT MATTERS

Taken together, the European Union is the world's largest economy. If it isn't growing, that weighs on everyone else. A lack of growth is also hurting the continent's efforts to rein in deficits and cut debts. When growth slows, so does tax revenue. That makes it harder for a government to balance their books ? which can mean they have to make even deeper cuts. But the cuts themselves eat into growth: when government jobs and state investment projects are slashed, people have less money in their pockets to spend

Breaking that cycle will be key to getting European economies growing again.

A New Jersey judge will decide later this week if the sender of a text message might be?partially liable for a horrific auto accident that occurred because the driver was reading that message on his cell phone and drifted into oncoming traffic.

With nearly half a million U.S. drivers injured in distracted driving-related accidents?every year, according to the National Highway Traffic Safety Administration, the judge?s decision could have wide-ranging impact in both the legal and digital realms.

While it might seem absurd to blame someone who isn't even in the car -- or anywhere near it -- for causing an accident, some legal experts say the plaintiff is on firmer ground than you might think.


Skippy Weinstein, a Morristown-based lawyer, is using similar logic to press the case he filed on behalf of David and Linda Kuber. Both Kubers lost their legs during a 2009 crash in Mine Hill, N.J., after 19-year-old Kyle Best sideswiped their car when driving while texting. Weinstein said Shannon Colonna, who was texting with Best, should also be held responsible for the Kubers? injuries.

"She was not physically in the vehicle but she was electronically present," Weinstein told msnbc.com. "She and he were assisting each other in a violation of the law."

That word "assisting" is at the crux of Weinstein's novel legal argument.?

Most readers will be familiar with the notion of "aiding and abetting" a criminal act and the guilt it brings: the man who knowingly holds the door for the gang is just likely to be convicted of bank robbery as the safe cracker.

More recently, this notion of aiding and abetting has been extended to civil liability cases, too, creating a basis for what's sometimes called "secondary" or "vicarious" liability. For the past two decades, most civil aiding and abetting cases have been limited to investment and securities fraud: An aggrieved investor might not only sue Bernie Madoff for stealing his money, for example, but also go after a third-party broker who repeatedly executed trades for Madoff. Even if the trader wasn't profiting from the scheme or part of a "joint enterprise,? a court might find the trader provided assistance to Madoff, and should have known that someone was likely be injured by his actions.

The aiding and abetting argument in injuries that give rise to lawsuits, known as "torts," is only beginning to find its way into other kinds of civil cases.

There's a simple three-pronged test to prove someone is partly to blame for causing an injury by aiding and abetting someone else. It is set out in the Restatement of Torts published by the American Law Institute, which guides most civil courtrooms:

1) The party the defendant assists must do a wrongful act;

2) The party must be generally aware of his or her role in the illegal or "tortuous" act;

3) The party must "substantially assist" in the principal violation.

Weinstein think his argument is easy to make.?The driver violated the law by texting while driving.?Colonna, the text sender, should have known that Best was driving home from work and had to know texting while driving was a violation, he said. Therefore, it's hard to argue that a text sender isn't substantially assisting in the creation of a text message conversation that violates New Jersey's driving laws.

"That very comfortably satisfies the third prong of the legal test," he said.

Colonna?s lawyer, Joseph McGlone, doesn't think the argument has any merit, and has asked Morris County Superior Court Judge David Rand to dismiss the case.?Rand is scheduled to rule this week on McGlone?s motion to dismiss the case.

The sender of a text message has no way to control or predict when the recipient will read it, McGlone argues.

"The sender of the text has the right to assume the recipient will read it at a safe time,? McGlone told the local Daily Record ?newspaper. ?It?s not fair. It?s not reasonable. Shannon Colonna has no way to control when Kyle Best is going to read that message."

He added that there is no precedent for heaping liability on a person on the other side of a text message conversation that causes?injury.

Of course, there's no precedent for a lot of legal areas in the Digital Age. In situations like this, judges usually turn to analogies. In driving injury cases, the judge has a bushel full to choose from.

For starters, it's hard to tag liability on anyone who isn't holding the steering wheel of the car while an accident occurs. Lawyers around the nation have repeatedly tried and failed to make passengers partly responsible for accidents caused by drunken drivers when passengers knowingly get into a car with an intoxicated driver.

There are exceptions, however.?A South Carolina court has said a passenger could be judged a "proximate cause" of an injury if the driver and passenger were in some kind of "joint enterprise," such as the passenger steering the car while the driver presses the gas pedal.

Passengers who have directly encouraged drivers to break the law -- by urging them to speed excessively or to drive in the oncoming lane as part of a game, for example -- have also been found liable, Weinstein says.

But to find a passenger liable, the South Carolina court said, "The passenger must have an equal right to control the direction and management of the vehicle." It seems hard to argue that a text message sender has equal ability to control the vehicle as the driver does.

But there are plenty of other situations where someone other than the driver has to pay after an injury accident, an extension of liability called ?imputed negligence.? The most common is when the driver is "an agent" of someone else -- when a pizza delivery man driving for work causes an accident, his employer is liable.? Parents are often liable for accidents their children cause if they kids are directly under their care.?

There's also concept called "negligent entrustment": if you knowingly let an unlicensed driver take your auto out for a spin, you will probably be liable for an accident he or she causes.?

Neither of those cases fit this situation well, however. So Weinstein has settled on a?simpler analogy.

"If she was in the vehicle and put her hands over his eyes so he couldn't see, she would be liable," he said. "(Texting with him) is as if she put her hands over his eyes."

Is texting the digital equivalent of willfully rendering someone blind? To even make that argument, and to press on with the aiding and abetting claim, Weinstein has to persuade the judge that Colonna knew that Best was texting while driving. Colonna's lawyers are contesting that point, but Weinstein says the pattern of texts between boyfriend and girlfriend make clear that she must have known he was on his way home from work.

But even if he fails on that argument, it's easy to imagine other lawsuits where evidence of knowledge by the sender could be hard to deny. A driver might directly text, "Hey, I'm driving home," for example.

That would make a big difference in a case like this, said Robert Mitchell, a Utah-based lawyer and author of a recent article on aiding and abetting claims.

"If there is conclusive evidence that the person sending the text messages to the driver knew the driver was texting while driving, we see no reason why a claim for aiding and abetting the driver?s negligent or reckless conduct could not be made. The case is probably weaker if there is no evidence of actual knowledge, but only evidence of ?constructive knowledge,?" said Mitchell, referring to a concept that the sender "should have known" the recipient was driving. "Courts disagree over whether constructive knowledge is sufficient to give rise to aiding and abetting liability."

Courts have found that the contribution by this third party in aiding and abetting cases can't be slight ? it must be ?significant.? For example, giving directions to the bank robber probably wouldn?t be substantial enough to get you prosecuted, but telling him what time security guard shifts change could be. And, as with most civil liability cases, the harm caused by the action doesn't have to be intentional.

Mitchell said this is the critical phrase in the American Law Institute's guidelines.

"If the encouragement or assistance is a substantial factor in causing the resulting tort, the one giving it is himself a tortfeasor and is responsible for the consequences of the other?s act. This is true both when the act done is (intentional) and when it is merely (negligent)," Mitchell wrote in his review, quoting the guidelines with added parenthesis. In fact, liability exists even if the third-party has no idea he or she is doing something illegal or negligent.

So in Mitchell?s view, it's a relatively easy to argue?that the texter "substantially assisted" the driver in causing the accident.?

"The third prong, substantial assistance, would be an easier hurdle to clear (than knowledge) since sending somebody a text message while driving distracts the driver and that distraction may ultimately cause the accident," he said.? "Of course defenses may include superseding or intervening causes to the underlying tort (the first prong), like bad weather, poor road conditions or visibility, avoiding someone or something on the road."

Not all experts agree, however. Maryland-based lawyer Bradley Shear, an expert in digital law, openly fretted about how far liability might extend if Weinstein is successful in his novel legal argument.

"What if someone is hopping on a boat, and they look down at a text, slip and drown? What if a doctor gets a text before a surgery that upsets him and he makes a mistake? Is the sender responsible?" he said. "If you start going down that route where are you going to draw the line?"

Mark Rasch, for head of the Justice Department?s Computer Crimes Unit, said he thinks the case will boil down simply into this question: Can anyone really prove that the sender of the text, Colonna, knew that Best would read it while driving? Absent such proof, there is no case, he says.

But he was concerned with the larger issue of extending liability through digital means.

?The real question here is, do we as a society want to impose a duty on the non-driving texter for accidents that happen when a recipient is driving?? he said. ?For now, it seems a reasonable place to draw the line at this: The person driving has a duty not to text. And the person on other end of line has no duty unless there are special circumstances.?

One special circumstance he envisioned: A boss or other person in a position of power who received a message from an employee saying, ?I can?t text, I?m driving,? but continued to send demanding texts with an implied threat if they weren?t answered quickly.

?The person in the position of authority might have liability then,? said Rasch, now a cybersecurity consultant with Virginia-based CSC Inc.

Complicating matters, juries can apportion liability, and theoretically could find a driver 90 percent responsible and the sender of a text 10 percent responsible. Damages can be similarly apportioned, although the realities of collections means the party with the deepest pockets usually pays the most in damages.

It?s also possible that Congress or state legislatures might?create a chain of liability, as states have done with dram shop laws, which make bars liable for injuries and damages caused by patron who are served after they?re drunk.

For his part, Weinstein demurs when asked if he's trying to set an important legal precedent or make law. He's just trying to win a case for his client, he said.

"The defense ... wants to make this into a cause celebre, but this is not complicated," he said. "A jury may find I'm wrong and thrown me out on my duff. ... All I'm saying is don't (text) while driving, and don't assist someone else in texting while driving."
